Terms and Conditions
When make a booking with Bali Deluxe Rentals.
Bali deluxe Rentals is an online digital platform (“BdR Platform”) that provides information about villa accommodation, vacation rentals and other information in-line with tourism activities in Bali. The BdR Platform refers to Bali Deluxe Rentals (“BdR”) website, mobile, tablet, TV and other smart applications, these associated to “BdR Services”. BdR Platform is owned and operated by PT. Bali Halaman Persada (registered in Indonesia – NIB No. 8120314121955) with its head office located at Villa Ayung E12, Sibanggede, Abiansemal, Badung, Bali – Indonesia. By using or accessing the BdR Platform, you agree to comply with and be bound by these terms and conditions.
These terms and conditions are general. Please note that each Provider of villa accommodation and leisure activity may have their own terms and conditions and may differ from what is stated in these terms and conditions. All additional requirements that have not been and are not listed in these terms and conditions shall be delivered at the amendment at the time of the booking correspondence.
Few Terms on this Policy
A “Member” is a registered user on BdR Platform account, including Clients and Suppliers. A “Client” is someone who books, or wishes to book a villa accommodation or an activity. A “Provider” is someone or a company who offers villa accommodation or travel-related services (“Villa Owner or Property Management and Travel-related Service Provider”) to be advertised and listed on BdR Platform. A “Supplier” is someone or a company who offers services (“Supplier Services”) via published listings on the BdR Platform. Accommodation means private villas, luxury private homes, private resorts or other form of vacation rental property. Travel-related Services means island tour arrangement, spa & wellness, river rafting, trekking, etc. These terms and conditions are written in English. The English writing will prevail over any translation available.
Agreement
Bali deluxe Rentals acts only as an independent sole agency by publishing, advertising and listing information provided by Providers to help Clients find and book villa accommodation or other travel-related activities. The Client who makes a reservation is valid only after a reservation is received by BdR along with the appropriate payments, and the reservation has been confirmed to the Client by BdR. By ticking the “I agree” box on Bali deluxe Rentals’ booking form the Client accepts these terms and conditions as well as confirms that he or she is authorized to do so and on behalf of all other persons accompanying during their vacation. By making a reservation through BdR Platform, the Clients enter into a direct, legally binding, contractual relationship with the relevant Provider. BdR sends the details of the reservation to Provider and sends the Client a confirmation email for and on behalf of the Provider and is not a party to the direct, legally binding, contractual relationship between the Client and the Provider.
BdR Services
Bali deluxe Rentals is an online villa accommodation and other travel-related services marketplace for Clients to find and reserve villa accommodation or travel-related activity through BdR Platform. Bali deluxe Rentals is not a travel agent, nor is BdR a property or real estate broker.
Availability Calendar
In this platform, availability calendar is available on each villa listing, however please note that NOT all of them are synced. Even though the calendar looks synced, we still need to confirm to the Provider to ensure the availability of the chosen villa accommodation.
Prices
All prices displayed on BdR Platform are quoted in IDR (Indonesian Rupiah). All transactions will be made in IDR (Indonesian Rupiah) from all available payment methods.
All prices for villa accommodation are includes the following, unless otherwise specified in the specific rental conditions:
- Use of a fully-equipped and furnished villa including in-villa staff for the duration of the period specified in the booking confirmation.
- Breakfast (if any).
- Welcome drinks and refreshments.
- Cost of electricity, water supply and LPG, internet Wi-Fi and TV satellite/cable channels subscriptions or streaming (if any).
- Villa maintenance cost including swimming pool and gardens (if any).
All prices for villa accommodation are NOT includes the following:
- Value Added Tax (VAT) and Service Charge. VAT and service charge are vary, ranging from 10% to 15.5% of total booking transaction. They shall be calculated on the invoice.
- Client’s personal expenses.
- Local or IDD phone calls.
- Travel insurance and any other personal liability insurance.
- Any optional services not previously specified and billed.
On Hold Request
Client are able to put villa accommodation “on hold” thru BdR Platform whereby BdR shall liaise with the Provider and request the dates for the villa accommodation be reserved for the Client for up to 48 hours. If the Client wishes to proceed with the booking BdR shall update the status of the booking to “Pending Payment” and issue an invoice for the Client to complete the payment. In the event the Client does not confirm the booking within 48 hours, the dates on hold shall be released.
Booking Procedures
Bali Deluxe Rentals requires confirmation from the Client and a deposit to be settled thru BdR payment system to confirm the reservation. BdR standard payment terms are 50% deposit payable at the time of booking, and 50% balance payable 60 days prior to arrival (unless otherwise stated in the specific booking conditions).
Booking Conditions
The Client must be at least eighteen (18) years of age. The villa accommodation is provided for the sole purpose of tourism only and any commercial use of the property is strictly forbidden. The Client represents and guarantees that he or she is renting the villa accommodation for the purpose of tourism only and under no circumstances may he or she establish residence at that address. The Client must accept that it is solely responsible for compliance with any and all laws, rules and regulations that may apply to its use of villa accommodation.
BdR reserve the right to terminate your stay in the event that the Client’s behavior or that of an accompanying guest is such that it is likely to cause distress, damage, danger or annoyance to other guests, staff, property or any third parties. If the Client or accompanying guest are prevented from travelling because in the opinion of any person in authority you or a member of your party appear to be unfit or likely to cause discomfort or disturbance to other parties, BdR will have no further liability to complete Client’s booking arrangements. Bali Deluxe Rentals will not be liable for any refund, compensation, or any additional costs incurred by the Client. BdR does not accept any liability for the behavior of others staying at our villa accommodation.
Clients and or their accompanying guests shall not disturb, endanger, or inconvenience neighbors, nor use the premises for any unlawful purposes, nor violate any law or ordinance, nor commit waste or nuisance on or about the premises. Any inappropriate or destructive behavior could result in the eviction of the entire Client’s party without refund.
The arrangement of the villa accommodation keys is always be a responsibility of the Client. The keys should be either collected from the in-villa manager unless stated otherwise at the time of check-in. At the time of check-out, it is the Client’s responsibility to return the keys to the same place where it’s collected.
Payment Procedures
The Client must responsible for the payments of all rental costs and for compliance with these terms and conditions.
A 50% deposit of the total price of your villa accommodation is required at the time of reservation, with a 50% remaining balance due 60 days before check-in date (unless otherwise specified in the specific rental conditions). If the remaining balance is not paid 60 days before check-in date, the BdR reserves the right to retain the deposit, cancel the booking and applying the cancellation charges.
Where the booking is made less than 60 days before check-in date then the full payment is due immediately to confirm the reservation.
Payment Methods
Payments for deposit or full payment can be made via the following methods:
- Credit card (VISA or Master Card) via Online Payment. An invoice of deposit or full payment in IDR at the time of reservation will be sent to Client’s email along with a link to access the online payment. Please note that our payment gateway using a mandatory 3Ds verification where a one-time SMS OTP (One Time Pin) will be sent by the credit card issuer to your mobile number once you press ‘Pay’ button. A 3% credit card handling fee is applied when payment is made thru VISA or Master Card credit card.
- Credit card (AMEX) via Online Payment. An invoice of deposit or full payment in IDR at the time of reservation will be sent to Client’s email along with a link to access the online payment. A 5% credit card handling fee is applied when payment is made thru AMEX credit card.
- Bank Transfer. An invoice of deposit or full payment in IDR will be sent to Client’s email along with BdR IDR bank account details. Client is responsible for all bank transfer fees.
Price Guarantee
Bali Deluxe Rentals guarantees that Clients are booking their desired villa accommodation at the lowest possible price. If at the time of booking Client found a genuine lower price advertised and receive a quote for the exact same dates, services and inclusions from another platform, BdR will match it and claim it to the Provider. To amend the price of a booking, BdR requires the Clients to write an email with support documentation before the “on hold” of villa accommodation is released (usually 48 hours from when the villa accommodation is put on hold). BdR price guarantee only applies if the following details are identical: villa accommodation type, number of guests, check-in and check-out dates and times, USD prices, tax and services, inclusions and booking terms and conditions. Bali Deluxe Rentals guarantees Clients the lowest possible price for every booking, except for misquotes, pricing errors or after a deposit has been paid to BdR (e.g. where prices have been changed by the Provider after the booking has been confirmed and payment has been received).
Security Deposit
On certain bookings, particularly in the most luxury and prestigious villa accommodation and based on the Provider policy, it may require a security deposit. The security deposit is either payable by the Client directly to BdR immediately upon arrival at the villa accommodation or collected by Bali Deluxe Rentals via the BdR payment system. The security deposit is refundable and shall be returned to the Client within 14 days of the check-out date. In the event of a security deposit is required the details of the policy will be stated on the BdR Platform’s listing and communicated with the Client during booking correspondence. Please note the BdR has the right to impose different requirements on a case by case basis and Client access to the villa accommodation may be refused if the required security deposit is not settled in full. In the event of a security deposit is required to be paid in cash, or when a non-standard security deposit applies, BdR will inform the Client in advance of the amount to be paid and any other conditions. The security deposit is typically refunded at the end of the rental period, after deducting payments related to:
- All additional expenses incurred on the Client’s behalf (e.g. additional charges for goods, services and staff which were not directly paid by the Client, and other charges, if applicable).
- The cost of replacement or repair for any loss or damage to the villa accommodation. If this cost cannot be reasonably determined prior to the client’s departure, BdR is entitled to withhold a reasonable estimate from the Clients security deposit, and will return any balance to the Client once after the actual cost has been determined.
Changes of Booking by Client
A change of booking means any changes made by Client only when the booking has been confirmed with appropriate payment.
Any changes of booking must be notified by email to Bali Deluxe Rentals as soon as possible. BdR will do the best to accommodate and assist any reasonable changes made by Client and discuss it with the Provider. If the change is allowed, an administrative fee of USD 50 per booking for each change will be applied in addition to any costs levied by the relevant Provider as a result of the change.
Changes of Booking by Provider
Holiday has been well planned in advance, but there may be times when Provider alter their villa accommodation or temporarily withdraw services or advertised facilities, without prior notice to BdR. In the event of changes made by Provider, BdR will discuss with the Provider and notify the Client with any possibility of compensations.
Cancellation of Booking by Client
Cancellation made of a confirmed booking, the following penalties will commonly apply:
- A 50% deposit of the total rental amount will be forfeited if the cancellation is made more than 60 days before check-in date (unless otherwise stated in the specific booking conditions).
- Up to 100% of the total rental amount will be forfeited if the cancellation is made between 1 and 59 days before check-in date (unless otherwise stated in the specific booking conditions).
Cancellation of Booking by Provider
In the event of cancellation made by Provider due to reasonable reasons, BdR has the right to substitute different villa accommodation to that booked by the Client of a similar or equivalent standard. Client has either the option of accepting the alternative villa accommodation offered by BdR. For the avoidance of doubt where the alternative villa accommodation has a lower price than the amount that the Client has paid, BdR will refund the difference and if the alternative villa accommodation has a higher price than the Client has paid then BdR reserves the right to charge the Client the difference between that amount and the increased price or the Client has the option of cancelling their rental and BdR shall use its best endeavors to promptly refund all payments paid.
Bali Deluxe Rentals only works with reputable Providers, however as BdR does not have direct control over such management organizations or their staff we therefore cannot take responsibility for them. In the unlikely event that circumstances beyond our control necessitate the cancellation of your booking we shall use our best endeavors to promptly refund all payments paid and BdR shall not be liable for any additional compensation.
Return Airport Transfer
Airport transfer is not available for some villas in which case an additional fee applies for this service. Please check the inclusions on the listing.
Special Requests
Special requests such as early check-in or late check-out are not guaranteed, however BdR will always do the best to look after the guests. Extra charges may apply and the Client may be charged directly by the Provider upon arrival or departure at the villa accommodation.
Special requests such as pool fence, baby sitter, spa therapist, fine dining, etc. can be arranged with extra charges upon arrival. These special requests must be advised by email to BdR during the booking correspondence.
Events
Bali Deluxe Rentals must be advised during booking correspondence if the Client is planning to hold a dinner party or special function exceeding the maximum number of guests during their stay. For larger functions additional costs will apply such as event fees, permit fees (Banjar fee) and extra staff.
Number of Guests
The number of guests staying at the villa accommodation cannot exceed the maximum number of guests published on the listing (unless otherwise stated in the specific booking conditions).
Property Damage
Any damage of the villa accommodation caused by Client must be reported to the BdR immediately and any cost of damage must be paid by the Client. If you are staying with children, please be alert that they do not use crayon or pen on cushions and sofas and fabric stains cannot be repaired. The Provider may wish to charge the Client the cost of replacement. The Client is responsible for leaving the villa accommodation in good order and in a clean condition as when the Client check-in. The Client further responsible to pay for any damages or losses incurred during their stay in the villa accommodation. The Provider reserves the right to evict the Client if the Client or accompanying guest has caused excessive damages.
Complaints by Client
BdR is committed to provide you the best villa accommodation available. However, should anyone have cause for reasonable complaint during the stay, the Client should speak with the villa staff right away. In the event of Client is unable to communicate with the villa staff or is not satisfied with the resolution to any issues provided by the villa staff, the Client is advised to contact Bali Deluxe Rentals. BdR shall use reasonable endeavors to rectify the problem except where circumstances are beyond BdR reasonable control. If the complaint cannot be rectified during the stay, the Client should contact Bali Deluxe Rentals in writing within 7 days of check-out date.
Building Works close to the Property
BdR takes steps to monitor such activity and shall advise the Client if any building work affects their booking, however this is not fully guaranteed. In the event BdR considers that a neighboring building works would seriously affect your booking with either noise or dust pollution or both, then we will use our best endeavors to find alternative villa accommodation under the terms of our booking conditions. In the event of road works or public works occur with or without notice, and which are beyond of our control, BdR cannot be held liable for any inconvenience.
Force Majeure
Bali Deluxe Rentals does not accept liability in any circumstances where performance and/or prompt performance of our obligations is prevented as a result of war, riots, civil strife, terrorist activities, natural disasters, industrial disputes, fire, nuclear explosion or adverse weather conditions.
Security during the Stay
All baggage and personal belongings retained at the villa accommodation are at the Client’ risk. Client is advised to secure valuables and personal items in the safety boxes (mostly available) when the Client is not in the villa and at night.
Most villa accommodation have private swimming pool. The swimming pool is used entirely by the Client and accompanying guests at their own risk. To avoid accidents, we advise Client to stay careful when using the pool. Please be advised that most villa accommodation do not equipped with pool fences so children in the swimming pool area should be supervised at all times. A pool fence can be arranged at an extra cost. Please check the inclusions on the listing for more information. The Client hereby releases Bali Deluxe Rentals and its Provider, including Supplier Services, of any claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages and liabilities, of any kind with respect to personal injury while using the swimming pool within the grounds of the villa accommodation.
By law in Indonesia, all guests must be registered with the local police station within 24 hours of arrival at their destination. A registration form will need to be filled out & signed by each guest and these papers will then be taken to the immediate village registration office.
Activities booked via the BdR Platform
Bali Deluxe Rentals allows the Client to book leisure activities through the BdR Platform. The Client may pay directly the activities simultaneously with the payment of the reservation of the villa accommodation or during the stay. The Activities are performed by the Client or the accompanying guests under their own responsibility and risks. Bali Deluxe Rentals shall not be liable for damages, injury, accidents, death, delay, cancellation or irregularity relating to or arising out during the practice of the activities, by the Clients or the accompanying guests, and any transportation during their trips.
Waiver & Release from Liability
Bali Deluxe Rentals and their Providers including Supplier Services are not liable for loss, damage of property, to or of Client or accompanying guests. The Customer assumes any risk, and takes full responsibility and waives any claims of personal injury, death or damage to personal property associated with the stated villa accommodation including but not limited to man-made hazards associated with the villa accommodation such as slippery shower basins, tubs, swimming pool facilities and natural hazards such as holes, ditches, fallen trees, branches, and or other irregularities in terrain and using the terrain including walking, jogging, biking or related activities. The Client hereby waives and releases, indemnifies, hold harmless and forever discharges Bali Deluxe Rentals and its Providers and employees and their respective Supplier Services, staff and employees from any and all claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages and liabilities, of every kind and nature, including claims of BdR or their employee negligence, whether known or unknown, in law or equity, that the Client ever had or may have arising from or related to participation in any of the events or activities, and for the duration of the stay at the stated villa accommodation.
